Terms of sale
Last updated 2 October 2026.
1. Who you are buying from
Ewan Wills, a sole trader trading as Ewan Wills Product Development.
3/1 Meadowbank Crescent, Edinburgh EH8 7AJ
contact@ewanwills.co.uk
Not VAT registered. Prices are the full price you pay.
These terms cover what you buy on this site: EWatch (bare PCB, kit, or assembled watch), EWrapper and custom mouthguard cases. EWatch Cloud has its own terms. Kickstarter pledges are covered by Kickstarter's terms and the campaign page, and I apply section 3 and sections 6 to 9 below to backers' rewards in the same way.
2. Ordering
Your order is an offer to buy. The contract is made when I email you an order confirmation. If I cannot accept an order (out of stock, a pricing mistake, an address I cannot deliver to) I will tell you and refund you in full.
Payment is by card through Stripe. Delivery anywhere in the UK is included in the price. I cannot deliver outside the UK yet.
Northern Ireland applies some extra product rules that England, Scotland and Wales do not. If you are in Northern Ireland your EWatch may ship later than orders for the rest of the UK, once those extra approvals are done. I will tell you if that affects you, and you can cancel for a full refund.
3. EWatch pre-orders: read this before you pay
EWatch is not yet certified for sale. It is a radio product (WiFi and Bluetooth) with a lithium battery, and it has to pass radio, electromagnetic compatibility, electrical safety and product security assessment before I am allowed to send it to anyone. That testing is under way and pre-orders help pay for it.
So a pre-order works like this:
- Nothing ships until certification is complete. I will not send an uncertified unit to get an order out of the door.
- Estimated delivery: April 2027 for The PCB, May 2027 for The Kit, June 2027 for The Watch. These are estimates, not promises. I cannot guarantee a date, because the date depends on test results I do not have yet.
- You are charged in full when you pre-order. Your payment goes towards certification and production.
- You can cancel for a full refund at any time before your order ships, for any reason, and for 14 days after it arrives (section 6). Email me and the money goes back to your card within 14 days.
- If the date moves, I will email you with the reason and a new estimate. You can wait or take a refund.
- If your order has not shipped three months after its estimated month, I will email you and ask whether you want to keep waiting or have your money back. If I do not hear from you within 30 days, I refund you.
- If certification fails and I decide not to continue, I will refund every pre-order in full without being asked.
- The product may change between your pre-order and delivery, because testing can force changes (the antenna and the display connector are both being revised). I will tell you about any change that affects what the product does. If you do not like the change you can cancel for a full refund.
- I will post progress on certification on the EWatch page at least once a month.
4. The three EWatch options are different products
- The Watch is a finished product. Charge it and use it.
- The Kit is for self-assembly. It includes a loose lithium polymer cell. You need to be comfortable handling small electronics, and you must follow the assembly and battery instructions. It is not suitable for children.
- The PCB is a bare circuit board and display for people who know electronics. It has no case and no battery. Anything you connect to it is your choice and your responsibility.
All three are programmable. You are free to write and flash your own firmware. Faults caused by firmware you wrote or installed, or by hardware you added or modified, are not faults in what I sold you. That does not take away any of your legal rights in section 8.
EWatch is not a medical device, not a safety device and not a toy. It is not suitable for children under 14.
5. Delivery
In-stock items are sent within 5 working days by Royal Mail Tracked, and you get the tracking number by email. If something will take longer I will tell you before you pay. If an in-stock item has not arrived within 30 days of your order, you can cancel for a full refund.
The goods are your responsibility from the moment they are delivered to the address you gave.
6. Your right to change your mind (14 days)
You can cancel an order for any reason from the moment you place it until 14 days after the day the goods arrive. For a pre-order that covers the whole wait as well.
To cancel, tell me clearly: email contact@ewanwills.co.uk, or use the form at the bottom of this page. You do not have to give a reason.
If you have already received the goods:
- send them back within 14 days of telling me, to the address in section 1;
- you pay the return postage. A product containing a lithium battery has to go by a service that accepts it: at a Post Office counter, declared as a device with a battery installed. For the Kit, email me first and I will tell you how to pack the cell;
- I refund the price and the standard delivery cost within 14 days of getting the goods back, or of you sending proof of posting, to the card you paid with;
- I may reduce the refund if the goods have been handled more than you would in a shop to see what they are. For a Kit that means I can deduct for a kit that has been soldered or assembled, or a cell that has been charged or damaged.
Custom mouthguard cases are made to your artwork or text, so the 14-day right to change your mind does not apply once I have started making yours. Your rights if it is faulty or not as agreed still apply.
7. Returns for any other reason
Outside the 14 days there is no general right to return something you no longer want. Ask anyway.
8. If something is wrong with it
By law the goods must be as described, of satisfactory quality and fit for purpose.
- Within 30 days of delivery: if it is faulty you can reject it for a full refund.
- Within 6 months: I get one chance to repair or replace it. If that does not work you can have a refund.
- After 6 months and for up to five years (Scotland) or six years (England and Wales): you may still have a claim if you can show the fault was there at delivery.
Email me with your order details and a photo or a description. I pay the return postage for faulty goods.
On top of your legal rights, I give a 12-month warranty on the assembled Watch against manufacturing defects, starting on the day it is delivered. The warranty does not cover accidental damage or breakage (drops, knocks, cracked screens, water), the battery wearing with use, or damage from modification or from firmware you installed. EWatch is not water resistant.
9. Safety, batteries and recycling
EWatch (Kit and Watch) contains a lithium polymer battery. Read the safety sheet in the box before charging. If a battery swells, gets hot, is punctured or smells, stop using it and email me.
Do not put electronics or batteries in household waste. When you buy an electrical item from me you can send me your old equivalent item for free recycling: email me and I will tell you how. Used batteries can go to any battery collection point.
10. What I am and am not liable for
I do not limit my liability for death or personal injury caused by my negligence, for fraud, for breach of your legal rights as a consumer, or for a defective product under the Consumer Protection Act 1987.
I am not responsible for losses that were not foreseeable when you ordered, for business losses (these are consumer terms; if you are buying for a business, my liability is limited to the price you paid), or for delay caused by events outside my reasonable control. If such an event delays your order by more than 30 days you can cancel for a full refund.
11. Complaints and law
If something has gone wrong, email contact@ewanwills.co.uk. I will reply within 5 working days and try to sort it out. I am not a member of an alternative dispute resolution scheme. If we cannot agree, Citizens Advice (England and Wales) or Advice Direct Scotland (consumeradvice.scot) can advise you.
These terms are governed by Scots law. If you live in England, Wales or Northern Ireland you keep the protection of your own consumer law, and you can bring a claim in the courts where you live.
I may update these terms. The version that applies to your order is the one in force when you placed it.
12. Cancellation form
You can copy this into an email. You do not have to use it.
